Terms of Service — Studio Members

Last updated: May 26, 2026 · Applies to individuals who use StudioBook to book classes at a US studio.

These terms apply to you ("you", "member") when you create a StudioBook account to book classes at a studio that uses StudioBook ("studio"). They form a binding agreement between you and Marcel Jurna, sole proprietor doing business as StudioBook ("StudioBook", "we", "us"). For terms applicable to studio owners, see Terms for Studios.

1. What StudioBook is — and isn't

StudioBook is a software platform. It lets the studio you're booking with manage class scheduling, take payments via Stripe, and communicate with you. StudioBook is not the studio. We do not own, operate, run, or insure any studio. We don't vet instructors, inspect facilities, or guarantee class outcomes.

When you book a class, your contract is with the studio, not with StudioBook. If you have a question about a class, a refund, an instructor, or a studio policy, contact the studio directly.

2. Account

To book classes via StudioBook, you create a StudioBook account using your email address. You agree to provide accurate information and keep it up-to-date.

You must be at least 16 years old to use StudioBook. If you are between 13 and 18, your parent or legal guardian must agree to these terms on your behalf in some jurisdictions. We do not knowingly collect data from anyone under 13.

You are responsible for maintaining the security of your account and your password. Notify us promptly if you suspect unauthorized use.

3. Studio policies

Studio policies — including class pricing, cancellation rules, credit/membership terms, refund policies, attendance requirements, and house rules — are set by each studio individually. StudioBook displays these policies as set by the studio but does not control or enforce them. For specifics, contact your studio directly.

4. Payments

When you purchase a class, credit pack, gift card, or membership, your payment goes through Stripe directly to the studio's bank account via Stripe Connect. StudioBook does not receive, hold, or process your payment. Standard Stripe fees apply (set by Stripe).

Recurring memberships auto-renew at the price and interval the studio set (typically monthly). You can cancel anytime in your account settings. Cancellation policies (when the cancellation takes effect, refund eligibility) are set by the studio.

5. Your data

  • For booking data, attendance records, and member-specific information, your studio is the data controller. StudioBook acts as the data processor on the studio's behalf.
  • For your StudioBook account itself (login credentials, account preferences), StudioBook is the data controller.
  • See our Privacy Policy for full details on what data we collect, how we use it, and your rights — including your rights under the California Consumer Privacy Act (CCPA), Virginia Consumer Data Protection Act (VCDPA), and other state privacy laws.

6. Communications

Studios may send you transactional emails (booking confirmations, class reminders, payment receipts) via StudioBook regardless of your marketing preferences. These are necessary for the booking relationship.

Marketing emails (newsletters, promotions, class announcements) require your separate opt-in for each studio, given via that studio's signup form or your account settings — opting in to one studio does not opt you in to any other. You can unsubscribe from a studio at any time using the link in any of its marketing emails (which affects only that studio) or per studio in your account settings, and we honor opt-outs within 10 business days as required by CAN-SPAM.

7. Class participation, safety, and liability

By booking a class, you assume the risks inherent in physical activity. Fitness, yoga, dance, martial arts, and similar activities involve physical exertion that may include risk of injury. You acknowledge:

  • You are responsible for assessing your own fitness for participation in any class.
  • The studio is responsible for the safety conditions of its facility, equipment, and instructors.
  • StudioBook is not the studio and does not insure, supervise, or operate any class. Any claim for injury or damage arising from class participation is against the studio, not StudioBook.
  • You should consult a physician before beginning any new exercise program if you have health concerns.

The studio may require you to sign a separate liability waiver before participating in classes. That waiver is a separate agreement between you and the studio.

8. Account deletion

You can delete your StudioBook account at any time from your account settings. Active subscriptions with studios must be cancelled separately before account deletion.

Deletion removes your account, profile, and personal data in accordance with our Privacy Policy. Note that:
- Studios may retain transaction records as required by law (typically 7 years for IRS purposes in the US).
- Studios may retain your name + email in their records for legal-compliance reasons even after you delete your StudioBook account.

9. Multi-studio membership

Your StudioBook account works at any studio using the platform. You can be a member at multiple studios with a single login. Each studio sees only its own relationship with you (your bookings + memberships with that studio, not the others).

10. Modifications

We may update these terms with at least 30 days' notice for material changes (sent to your account email). Continued use after the effective date constitutes acceptance.

11. Limitation of liability

To the maximum extent permitted by law, StudioBook's total liability to you arising from your use of the Service is limited to one hundred U.S. dollars ($100). We are not liable for any indirect, consequential, or punitive damages.

This limit does not apply to liability that cannot be limited under applicable law.

12. Governing law and arbitration

These terms are governed by German law. Any dispute is resolved by binding individual arbitration administered by JAMS in New York, NY (or virtually). Class actions are waived. You may opt out of arbitration within 30 days of first agreement by emailing `hello@studiobook.app` with subject "ARBITRATION OPT-OUT". You may also bring claims that qualify for small-claims court in your state in that forum.

Full dispute-resolution terms mirror Section 14 of the Studio Terms of Service.

13. Provider

StudioBook is operated by Marcel Jurna, German sole proprietor, with mailing address Am Glockenberg 52, 51515 Kürten, Germany. Contact: `hello@studiobook.app`.
